De maximale huurverhoging zal net zoals in voorgaande jaren afhankelijk zijn van het huishoudinkomen van de huurder(s). Voor de huurverhoging per 1 juli 2019 zal de verhuurder naar het huishoudinkomen kijken van 2017. Het huishoudinkomen zijn alle inkomens gezamenlijk van alle bewoners van de huurwoning, bijvoorbeeld van partner(s) en\/of kinderen.<\/em><\/p><p><strong>Zelfstandige woonruimte<\/strong><\/p><p>Bedroeg het huishoudinkomen van de huurder(s) in 2017 \u20ac 42.436,- of minder, dan mag de huurprijs in 2019 niet meer dan 4,1% stijgen. Was het huishoudinkomen meer dan \u20ac 42.436,-, dan mag de huurprijs met maximaal 5,6% stijgen. Indien sprake is van de hogere huurverhoging zal de verhuurder bij het voorstel tot huurverhoging een huishoudverklaring van de Belastingdienst bij moeten voegen. Uit deze verklaring blijkt dat het huishoudkomen van de huurder(s) in 2017 meer dan \u20ac 42.436,- bedroeg. Deze hogere huurverhoging geldt echter niet voor huishoudens waarvan 1 of meer bewoners de AOW-gerechtigde leeftijd hebben bereikt op de voorgestelde datum van de huurverhoging. Daarnaast geldt de hogere huurverhoging niet voor huishoudens die bestaan uit vier of meer personen. Voor deze huishoudens geldt de maximale huurverhoging van 4,1%.<\/p><p><strong><em>Kamerverhuur, woonwagen en woonwagenstandplaats<\/em><\/strong><\/p><p>Voor de huur van kamers, woonwagens of woonwagenstandplaatsen geldt dat de huurprijs vanaf 1 juli 2019 maximaal met 3,1% mag stijgen. In dit geval is de maximale huurverhoging niet afhankelijk van het huishoudinkomen van de huurder(s).<\/p><p><strong>Voorstel huurverhoging<\/strong><\/p><p>De huurprijs van een sociale huurwoning wordt niet automatisch jaarlijks verhoogd. Op grond van artikel <a href=\"\/en\/\\&quot;http:\/\/wetten.overheid.nl\/jci1.3:c:BWBR0005290&amp;boek=7&amp;titeldeel=4&amp;afdeling=5&amp;paragraaf=Onderafdeling_2&amp;sub-paragraaf=1&amp;artikel=252&amp;z=2019-01-01&amp;g=2019-01-01\\&quot;\/\" target=\"\\&quot;_blank\\&quot;\" rel=\"\\&quot;noopener\\&quot;\">7:252 van het Burgerlijk Wetboek<\/a> dient de verhuurder tenminste twee maanden voor de voorgestelde dag van ingang van de <a href=\"\/en\/\\&quot;https:\/\/avcadvocaten.nl\/huurprijs\/\\&quot;\/\" target=\"\\&quot;_blank\\&quot;\" rel=\"\\&quot;noopener\\&quot;\">huurverhoging<\/a> de huurder schriftelijk een voorstel te doen voor de huurverhoging. In dit voorstel dient minimaal te worden vermeld:<\/p><ul><li>de huidige huurprijs;<\/li><li>het percentage en\/of het bedrag waarmee de huurprijs wordt gewijzigd;<\/li><li>de voorgestelde huurprijs;<\/li><li>de voorgestelde dag van ingang van de nieuwe huurprijs;<\/li><li>de wijze waarop de huurder bezwaar kan maken tegen de voorgestelde huurprijs en de gevolgen van het geen bezwaar maken.<\/li><\/ul><p>Kort gezegd betekent dit dat de huurder uiterlijk op 30 april 2019 een voorstel zal moeten hebben ontvangen voor de huurverhoging indien de verhuurder deze wenst in te laten gaan per 1 juli 2019.
